Welcome to Lumin Labs DMCC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our mobile applications, websites, and related services (collectively, the "Services") operated by Lumin Labs DMCC, a company registered in Dubai, United Arab Emirates.

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Services. You must be at least 18 years old to use our Services.

2. Description of Services

Lumin Labs provides AI-powered mobile applications for iOS devices. Our Services include:

• Mobile applications with AI-driven features and functionality
• User account creation and management
• Subscription-based premium features
• AI-powered image analysis and processing
• Personalized content and recommendations
• Customer support and technical assistance

3. User Accounts

3.1 Account Creation

To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

4. Subscriptions and Payments

4.1 Subscription Services

Some features of our Services are available only through paid subscriptions. Subscription fees are charged on a recurring basis as specified at the time of purchase.

4.2 Payment Processing

Payments are processed through third-party payment processors including Lemon Squeezy and Apple's App Store. You agree to pay all fees and charges incurred in connection with your use of the Services.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings or the App Store.

4.4 Refunds

Refund policies are governed by the platform through which you purchased the subscription (App Store, Lemon Squeezy). We do not provide refunds except as required by applicable law.

5. Acceptable Use

5.1 Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

• In any way that violates applicable laws or regulations
• To transmit or procure sending of any advertising or promotional material without our consent
• To impersonate or attempt to impersonate the Company, our employees, another user, or any other person
• To engage in any conduct that restricts or inhibits anyone's use of the Services
• To attempt to gain unauthorized access to our systems or networks

5.2 User Content

You retain ownership of any content you submit to our Services. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content solely for the purpose of providing our Services.

6. AI Services and Data Processing

6.1 AI-Powered Features

Our Services utilize artificial intelligence and machine learning technologies. You understand that AI systems may not always be accurate and that results may vary.

6.2 Data Processing

By using our AI features, you consent to the processing of your data as described in our Privacy Policy. This includes sending data to our servers and third-party AI service providers.

7. Intellectual Property Rights

The Services and their original content, features, and functionality are and will remain the exclusive property of Lumin Labs DMCC and its licensors. The Services are protected by copyright, trademark, and other laws.

You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Services, to understand our practices regarding the collection and use of your personal information.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

We strive to maintain the Services but cannot guarantee uninterrupted availability. The Services are provided "as is" and "as available" without warranties of any kind.

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Lumin Labs DMCC be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9.3 Maximum Liability

Our total liability to you for any damages arising from or related to these Terms or the Services shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Lumin Labs DMCC and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Services or violation of these Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

12. Third-Party Services

Our Services may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.

13. App Store Terms

If you download our app from the Apple App Store, you acknowledge that these Terms are between you and Lumin Labs DMCC, not Apple. Apple is not responsible for the app or the content thereof, and has no warranty obligations with respect to the app.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Services after the effective date of the revised Terms constitutes acceptance of the changes.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
